Terms of Use

These Terms of Use ("Terms") govern your use of DOMIQ, including the DOMIQ mobile application, website and related services (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms.

The Service

DOMIQ helps users organize information about their homes, rooms, appliances and other assets, documents, warranties, maintenance, repairs and reminders.

Features may change, be improved, replaced or discontinued over time. We may also temporarily restrict access to parts of the Service for maintenance, security or operational reasons.

Your Account

You are responsible for maintaining the confidentiality and security of your account credentials and for activity performed through your account. You are responsible for providing accurate information and keeping your account information reasonably up to date.

You must not use the Service for unlawful purposes, interfere with its operation, attempt to gain unauthorized access to accounts or systems, or use the Service in a way that could harm DOMIQ or other users.

Homes and Household Sharing

DOMIQ may allow you to invite other people to access a shared home. Depending on their permissions, household members may be able to view, add, update or remove information associated with that home.

You are responsible for inviting only people you trust and for managing access to homes you own. Information added by household members may be visible to other authorized members of the same home.

Your Content

You retain ownership of information, photographs, documents and other content that you upload or create in DOMIQ ("Your Content").

You grant DOMIQ a limited, non-exclusive right to host, store, process, reproduce and display Your Content only as necessary to operate, maintain and provide the Service to you and other users with whom you choose to share it.

You are responsible for ensuring that you have the right to upload and share Your Content and that doing so does not violate applicable law or the rights of another person.

Subscriptions

Some DOMIQ features require a paid auto-renewable subscription. Available subscription plans, prices, billing periods and any applicable introductory or promotional terms are displayed before purchase.

Payment is charged through the applicable app store at confirmation of purchase. Unless canceled, an auto-renewable subscription renews automatically according to the terms shown by the app store.

You can manage or cancel your subscription through your app store account settings. Cancellation stops future renewals but does not normally terminate access for a subscription period that has already been paid for.

Billing, refunds, renewals and payment processing are handled by the applicable app store and are also subject to that store's terms and policies.

Reminders and Maintenance Information

DOMIQ may provide reminders, maintenance schedules, warranty dates and other informational features based on information stored in the Service. These features are provided for organizational convenience only.

Notifications and reminders may be delayed, unavailable or not delivered because of device settings, network conditions, operating system restrictions or other circumstances. You should not rely on DOMIQ as the sole method for remembering safety-critical, legally required or time-sensitive tasks.

No Professional Advice

DOMIQ is an organizational tool and does not provide legal, insurance, financial, engineering, electrical, plumbing, construction or other professional advice.

Maintenance information, warranty information and reminders do not replace manufacturer instructions, product documentation, applicable laws or advice from qualified professionals.

Account Deletion

You may request deletion of your DOMIQ account through the application where this feature is available.

Deleting an account may permanently remove homes, assets, documents, maintenance records and other data owned by that account. If a home is shared with other household members, deletion of the owner's home may also remove their access to information associated with that home.

Certain information may be retained where reasonably necessary for security, fraud prevention, legal compliance, dispute resolution or other legitimate purposes described in our Privacy Policy.

Service Availability

We aim to provide a reliable Service, but we do not guarantee that DOMIQ will always be available, uninterrupted, error-free or free from data loss.

You are responsible for keeping copies of information or documents that are important to you where appropriate.

Suspension and Termination

We may suspend or terminate access to the Service where reasonably necessary to protect users or the Service, address security threats, prevent abuse, comply with legal obligations or respond to a material violation of these Terms.

Disclaimer and Limitation of Liability

To the maximum extent permitted by applicable law, the Service is provided on an "as is" and "as available" basis without warranties that the Service will meet every requirement or operate without interruption or error.

To the maximum extent permitted by applicable law, DOMIQ will not be liable for indirect, incidental, special or consequential losses arising from the use of or inability to use the Service, including losses resulting from missed reminders, inaccurate user-provided information or loss of access to stored content.

Nothing in these Terms excludes or limits rights or liabilities that cannot legally be excluded or limited under applicable law.

Privacy

Our collection and use of personal information is described in the DOMIQ Privacy Policy.

Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date and, where appropriate, provide additional notice.

Your continued use of the Service after updated Terms become effective constitutes acceptance of the updated Terms, except where applicable law requires a different form of consent.

Governing Terms

These Terms are governed by applicable law. Nothing in these Terms limits any mandatory consumer rights that apply to you in your country or region.
